Best "Rawr" Contest Official Rules NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. VOID WHERE PROHIBITED. The sponsor of the Best "Rawr" Contest ("Contest") is Pet Holdings, Inc, 190 Queen Anne Ave., Suite 250, Seattle, WA 98109 (the "Sponsor") and Sponsor is solely responsible for all aspects of the Contest. The Contest shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein. 1. After you have completed the required information and uploaded your Photo, you will receive one (1) entry ("Entry") in the Contest. By submitting your Entry, you agree that your Entry conforms to the Entry Guidelines and Content Restrictions as defined below (collectively, the "Entry Guidelines and Restrictions"). Photo must be submitted in JPG, PNG or GIF format and cannot exceed the file upload size limit as indicated by the upload form page. Each entrant may submit an unlimited number of Entries during the Entry Period. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register for an account will be deemed to be the registrant or player. No Entry will be acknowledged or returned. Sponsor, in its sole discretion, may feature any Photo submitted in this Contest at any time during, or after, the Entry Period on any related websites, in any promotional materials, whether related or unrelated to the Contest, and at any other location, whether physical or online, that Sponsor, in its sole discretion, deems appropriate for the operation and promotion of this Contest. 4. WINNER DETERMINATION: At the end of the Entry Period, qualified judges selected by Sponsor in its sole discretion (the "Judges") will select the winning entry ("Winner") based on the following criteria ("Judging Criteria"): 50% originality and 50% fit with the theme. Winner will be notified by email using the contact information provided with the original entry in the form of the reply-to field. If winner does not respond by email to the notification within 3 days, they will be disqualified and an alternate winner will be selected. Winner of the Contest will be required to complete and return (within 10 days of written notification) an Affidavit of Eligibility and Liability/Publicity Release. Failure to comply with the 10-day time period may result in disqualification and an alternate winner selected. Winner's Entry submission and acceptance of the prize offered constitutes permission (except where prohibited) for the Sponsor to use said winner's name, photograph, likeness, statements, biographical information, voice and address (city and state) and Photo, in all forms of media worldwide, in perpetuity, without limitation, notice or further compensation. 5. REPRESENTATIONS AND WARRANTIES BY ENTRANT: By submitting an Entry the participant warrants he or she own all copyrights to the uploaded Photo and that (i) the Entry complies with the Terms of Use and these Official Rules, including without limitation all Entry Guidelines and Content Restrictions; (ii) the uploaded Photo does not infringe the copyright, trademark, patent, trade secret, right of privacy, right of publicity or other legal right of any third party; and (iii) the Entry complies with all applicable laws, rules, and regulations; (iv) there are no claims, demands or any form of litigation pending or threatened with respect to any Entry; (v) Promotion Parties will not be required to make any payments to any third party in connection with its use of any Entry; (v) each entrant shall indemnify and defend the Promotion Parties against any and all claims or causes of action arising out of any of any of the foregoing representations and warranties. 6. GRAND PRIZE. One (1) will be awarded. Grand Prize consist of the "Will Ferrell in Hi-Def package" : A Blu-ray DVD player (specific manufacture, model and features selected at sole discretion of Sponsor) plus the following movies (in Blu-ray format if available):Elf, Semi-Pro, Talladega Nights, Old School, Blades of Glory, Stranger than Fiction, Step Brothers with an approximate estimated retail value of $499. 7. PRIZE CONDITIONS: 1) All taxes and expenses not specified here are the sole responsibilities of the winner; 2) prize is non-transferable; and 3) no prize substitutions are allowed (except by Sponsor). 8. LIMITATIONS OF LIABILITY: In the event of a printing or production-related error, Promotion Parties shall have no liability. In no event shall more prizes be awarded than the number stated in the "Grand Prize" section above. All federal, state and local taxes are the sole responsibility of winner. Acceptance of the prize constitutes permission to the Sponsor and its affiliates to use winner's names and/or likeness for advertising and publicity purposes, without further compensation, except where prohibited by law. By participating, the entrant agrees to release, defend, hold harmless and indemnify the Promotion Parties and their respective parents, directors, officers, employees, shareholders and agents against any and all liability, damages claims or causes of action (however named or described), with respect to or arising out of entrant's participation or inability to participate in this Contest, and/or the receipt, use or misuse of the prizes awarded herein. 9. GRANT OF RIGHTS; WARRANTIES AND REPRESENTATIONS: As a condition of participation in this Contest, each entrant hereby grants and agrees to grant to Sponsor and its affiliates the non-exclusive right and license to reproduce, modify, use, post, publish, perform, display, and otherwise distribute online on the Entry Site, and or otherwise use or exploit in connection with the promotion, publicity and/or advertising of the Contest each uploaded Photo (including, without limitation, the likenesses of the entrant appearing in the uploaded Photo) submitted by the entrant as part of his/her Entry process. Each entrant warrants and represents that with respect to the uploaded Photo submitted by him/her for purposes of Entry into the Contest, the entrant has, prior to submitting such uploaded Photo, obtained all necessary rights (including, as applicable, copyright, moral rights, publicity and privacy rights), licenses, consents and authorizations from any other individual appearing in the uploaded Photo (and/or such other individual's parent or legal guardian if the other individual is a minor) and from the person (if that person is an individual other than the entrant) who shot the uploaded Photo, to allow entrant to grant the rights granted by entrant pursuant to these Official Rules and to allow Sponsor's and/or its affiliates' free and unrestricted exercise of such rights as provided hereunder.
